Pre-Order Agreement Terms & Conditions
E-DOLPHIN S300 Electric Personal Watercraft (EPWC)
Introduction
This pre-order agreement (the “Agreement”) outlines the terms regarding pre-ordering your S300 Electric Personal Watercraft (EPWC) from E-DOLPHIN (“the Company”), a private limited liability company incorporated in France.
This Agreement takes effect only after the Company has received the pre-order payment for the S300 (the “Pre-Order Payment”).
Order Process
This Agreement does not constitute a sales contract. By submitting the Agreement and paying the Pre-Order Payment of 1,000€, you are reserving the right to purchase an S300 manufactured by the Company (the “Pre-Order”).
The Pre-Order Payment is refundable, and you may cancel your Pre-Order at any time before accepting a Sales Contract.
As the S300 is still under development, its features, technology, and design may be subject to change. The Company reserves the right to modify or cancel your Pre-Order at its sole discretion. If the Company cancels your Pre-Order, your Pre-Order Payment will be refunded in full.
Configuration and Pricing:
Once your Pre-Order is confirmed and your configuration options become available, the Company will invite you to finalize your S300 setup and disclose the final price.
The final price will include your configuration, taxes, logistics charges (e.g., transport, storage, and packaging), and other applicable fees.
The Pre-Order Payment will be deducted from the final price if a Sales Contract is executed.
Confirmation of Sales Contract:
When production planning allows, the Company will send you an offer (the “Offer”) for a Sales Contract.
You have 30 days from the date of the Offer to accept the Sales Contract.
Cancellation & Changes
If you do not wish to enter into a Sales Contract or want to cancel your Pre-Order, you may do so by submitting a written notice to info@edolphin.com.
The Company will refund your Pre-Order Payment within 30 calendar days of receiving your cancellation notice.
If you neither accept the Sales Contract nor cancel your Pre-Order, the Pre-Order Payment will remain with the Company until written cancellation is received.
No interest will be paid on the Pre-Order Payment unless there is a delay in refunding beyond 30 calendar days.
Modifications:
Changes to the S300’s configuration may affect pricing. A new Sales Contract Offer will be made for any changes.
Privacy Policy

Payment
The Pre-Order Payment is payable after completing the online pre-order form at [www.e-dolphin.com].
Payments can be made via credit card (subject to accepted options) or bank transfer.
Dispute Resolution & Applicable Law
Consumers:
This Agreement is governed by France law. Disputes may be settled in the courts of the consumer's domicile within the EU or through the ODR platform (ec.europa.eu/odr).
France-based consumers may also refer disputes to the Local Consumer Protection Agency.
Business Clients:
Disputes may be resolved through arbitration under the France Chamber of Commerce Arbitration Rules. Arbitration will take place in Toulon, France, with proceedings in English unless otherwise agreed.
VAT (Value Added Tax)
The Company is not responsible for customers' tax planning.
For orders outside the EU, customers are required to handle import tax obligations independently.
Limitation of Liability
Neither party shall be liable for incidental, special, or consequential damages arising from this Agreement.
Export Control / Sanctions
The S300 and this Agreement may be subject to export control laws or sanctions. Customers must comply with all applicable laws related to export and import licensing.
Discontinuation
The Company reserves the right to cancel any Pre-Order suspected of being made for resale purposes.
